An advance healthcare directive allows a person to designate another to handle the person’s healthcare affairs in the event the person becomes incapacitated. The advance health care directive also allows the person to dictate what type of medical care they would like to receive in the event they become incapacitated.
In California, an advance healthcare directive is separate and distinct from a durable power of attorney. A person could designate the same individual to serve as both the durable power of attorney and agent under the advance healthcare directive, but appropriate, separate documents need to be prepared for both.
