Hey everyone, it’s attorney Brian Russ coming at you with another 60 second law bite. So today’s topic is what is a click wrap agreements. So click wrap agreements are generally considered to be those agreements you get when you’re signing up for something online or in a digital medium that enters into a binding agreement. So imagine like you’re going to buy something online and there’s a little checkbox that says “by checking this box, you agree to the terms and conditions”, and the word “terms and conditions” is hyperlinked. So that’s what’s considered a click wrap agreement. Now there’s lots of different taxonomies regarding these digital contracts, and we’ll call them click through agreements. Some people call them browse wrap agreements sign and wrap agreements, etc. But essentially, they’re all kind of the same. Meaning that you show assent to the terms of contract by clicking on something. And so I prefer the term click through agreement, but people like click wrap. So essentially click wrap is an agreement or a contract which you enter into by clicking on something and sometimes that’s maybe tapping on your phone, or clicking on the computer screen, but that’s essentially it’s a contract where the assent is shown by clicking
